Platform holder contesting ancient fine

Nintendo are contesting 2002's EU price-fixing fine, saying not only was the figure involved unfair, but the move itself was actually 'illegal'.

Nintendo, alongside seven distribution partners, were fined 167.8 million Euro, based on collusion between 1991 and 1998, which the EU believe artificially raised game and console prices.

"The penalty was unfair, illegal, even shocking," said Nintendo's lawyer, speaking at court in Luxembourg. "This remains one of the biggest single fines in EU competition law."

The EU's representative disagrees: "The fine was not of a capricious nature, or based on wild estimates. This fine was for an infringement that was considered very serious."
